How did beliefs about individual rights travel from Cicero to Locke?


This rather long post follows on from one in which I asked how we got from natural law to natural rights. In case you are wondering, the “we” referred to are people who currently have relatively broad scope to exercise natural rights to liberty. 

I concluded the preceding post by suggesting that many of the ingredients of John Locke’s view of liberty and natural rights, enunciated in the 17th century, were already present in Cicero’s account of natural law from the 1st century BC.

This post is about the ways in which beliefs about individual rights were transmitted, or evolved, over time. When people think about the transmission or evolution of beliefs and shared values it is common to have in mind a process in which books and other media are maintained or rediscovered, and thinkers reject or build on the premises of the reasoning of those who came before.

However, transmission and evolution of beliefs about individual rights can also occur as people observe the spontaneous evolution of rules of just conduct and social norms. It is possible for such evolution to occur spontaneously as “the result of human action but not human design” (to use an expression coined by Adam Ferguson, but much loved by Friedrich Hayek). Evolution of the English common law is often cited as an example of that process.

How much can be explained in terms of the spontaneous evolution of rules?

Hayek began his discussion on the classical and medieval tradition of the evolution of law by noting that even in the height of democracy in ancient Athens it was not possible to alter the rules of just conduct by a simple decree of the assembly. A change could only be brought about through a complicated procedure involving a specially elected body (Law, Legislation and Liberty (LLL), V1, p82). He also notes that classical Roman civil law was almost entirely the product of law-finding by jurists rather than legislation. (See the preceding post for Cicero’s quoting of Cato in support of that view. Hayek included that quote in Constitution of Liberty, p57). The famous law code of the Emperor Justinian was largely a collection of past laws and extracts of the opinions of Roman jurists.

Hayek argues that in the early medieval period, for about 1,000 years, law was again regarded as something to be discovered, not made. He quotes Fritz Kern:
There is in the Middle Ages, no such thing as the ‘first application of a legal rule’. Law is old; new law is a contradiction in terms; for either new law is derived explicitly or implicitly from the old, or it conflicts with the old, in which case it is not lawful” (LLL, V1 p 83).

Larry Siedentop describes how the Christian church created canon law in the 12th century by sifting through Roman law to establish which rules were compatible with Christian beliefs. Canon law covered aspects of private and criminal law including usury as well as marriage, adultery and divorce. Siedentop comments:
Little wonder that at times civil lawyers felt their domain was under threat” (Inventing the Individual, p 212).

Hayek notes that from the 13th century onwards, law making on the European continent gradually came to be regarded as an act of the will of the ruler. He suggests that was associated with the rise of absolute monarchy. England managed to preserve the medieval ‘liberties’, because of “a deeply entrenched tradition of common law” under which jurists “had developed conceptions somewhat similar to those of the natural law tradition” (LLL, V1, p 84-5). Hayek mentions the contribution of Edward Coke in defending the common law tradition against King James I and Francis Bacon, that of Mathew Hale in opposition to Thomas Hobbes.

That account almost takes us to John Locke. In his discussion of natural rights, Locke does not seem to have acknowledged the relevance to his views of the common law of England. However, as noted by Stephen Shepherd, Locke left evidence that he had read Coke and that he was influenced by near contemporaries, who had learned the law from Coke and the common lawyers. Shepherd also points out that Locke’s account of property rights has parallels in the common law (‘The Common Law and the Constitution’, American Society of Legal History, November 2005).

Spontaneous evolution via legal processes can explain how many ideas about natural rights evolved and persisted, but has limited capacity to explain recognition of natural rights of people who haven’t had standing in the courts. Judges can only discover individual rights in respect of cases that are brought before them. For example, the famous case (Somerset v Stewart) in which Lord Mansfield found slavery to be unsupported by the common law of England was decided in 1772 (many years after Locke died). The case was heard because Somerset's three godparents, from his baptism as a Christian in England, made application to the court on his behalf. Lord Mansfield narrowly limited his judgment to the issue of whether a person, regardless of being a slave, could be removed from England against their will, and said they could not.

A more fundamental limitation of spontaneous evolution of natural rights arose because in medieval times the common law was constrained by the influence of church authorities. For example, English common lawyers conceded jurisdiction to the church courts in relation to usury, defined then as "whatsoever is taken for a loan beyond the principal". The common law courts did not protect the rights of individuals to engage in mutually beneficial arrangements to borrow and lend money.

In order to understand the evolution of rules in relation to matters such as usury it is necessary to consider the evolution of reasoning about natural law.

How was Locke influenced by the evolution of reasoning about natural law?

Locke attributes the view that all are created equal “with no-one being subjected to or subordinate to anyone else” to Richard Hooker (1554-1600), an influential theologian in the Church of England:
The judicious Richard· Hooker regards this natural equality of men as so obvious and unquestionable that he bases on it men’s obligation to love one another, on which he builds their duties towards each other, from which, in turn, he derives the great maxims of justice and charity”.

Such views are, of course, central to Christianity. By mentioning Richard Hooker, however, Locke was indicating that he wanted to link his views to the symbolism of natural law which, as Linda Raeder has observed, was “a well-developed tradition of Western moral and political discourse”:
“The symbol was first advanced by the ancient Greeks, impressively elaborated by the Roman Stoics (most notably the Roman orator Cicero [106-43 B.C.]), and later incorporated into the Christian tradition as the “unwritten” law embedded in the heart of man and similar constructs. During the Middle Ages Thomas Aquinas (1225-1274), the “Angelic Doctor,” provided Christian civilization with a philosophical elaboration of the natural law that remains a characteristic element of Roman Catholic teaching to the present day” (The Nature and Purpose of Government, A Lockean View, 2017, p25).

As Larry Siedentop has pointed out, some leaders of the early Christian church recognised freedom of religion. Tertullian (c 155 – c 240) argued that “it is a basic human right that everyone should be free to worship according to his own convictions” (Inventing the Individual, 2015, p 78). Unfortunately, many of the church leaders who followed did not recognise such basic human rights.

Augustine (354 – 430) acknowledged the ethical significance of free will, and tried to strike a balance between fatalism and the belief that individuals could achieve salvation by their own efforts. He emphasised that it is important for individual Christians to develop a moral perspective, or conscience, and argued that it was the task of the church to try to create and tend consciences. Augustine’s emphasis on the importance of conscience set the scene for theologians who came much later to recognise freedom of conscience.

In the 9th century, Eriugena, an Irishman, known by his contemporaries as John the
Scot, produced a vigorous defence of free will against those who claimed the authority of Augustine for their view that “predestination applies both to good and bad” (Darrin McMahon, Happiness: A History, 2006, pp 110 – 112).

Research by Brian Tierney (discussed in Larry Siedentop’s book, pp 245-9) found the idea of natural rights to be present in 12th century canon law. Important contributions, including those of Rufinus, Odo of Dover and Hugguccio, led to a range of individual rights – overlapping those recognised by jurists in ancient Rome - being defended in terms of natural justice.
   
Thomas Aquinas (1225 – 1274) gave some recognition to freedom of conscience. He acknowledged that under some circumstances a person is justified in acting in accordance with an erring conscience, even if this entails disobeying the state. Nevertheless, he defended persecution of religious heretics.

Aquinas made an important contribution to liberty in recognising that laws exist primarily to enforce the rules of justice, rather than to make human beings virtuous (George H Smith, The System of Liberty, 2013 p 91).

Arguably, Aquinas’ most important contribution to liberty came indirectly via his Christianisation of the teachings of Aristotle. Aquinas argued that individuals can attain some happiness in this world through their natural capacity for contemplation of (religious) truth. Darrin McMahon suggests:
Aquinas’s opening up of a space in which ‘some partial happiness can be achieved in this life’ continued a process of restoring agency to the individual that had received impetus from the work of Eriugena and others during the Carolingian Renaissance” (op. cit. pp 129 – 131).

In the 13th century, John Duns Scotus argued that “an act is neither praiseworthy nor blameworthy unless it proceeds from the free will” and, in the 14 the century, William of Ockham associated reason with individual experience and choice, and saw ‘right reason’ as obligated by principles of equality and reciprocity. (I wrote about Duns Scotus and Ockham in my review of Siedentop’s book.)

In the 16th century, the late Spanish scholastics made important contributions to recognition of natural rights. Murray Rothbard highlighted the role of Francisco de Vitoria (c 1450 – 1514) who denounced the conquest and enslavement of the Indians of the New World (Economic Thought Before AdamSmith: An Austrian Perspective on the History of Economic Thought, V1, p 102). Rothbard also notes that some of those who followed Vitoria in the Salamanca school, made important contributions in defining circumstances in which the charging interest on loans was acceptable. Juan de Mariana (1536 – 1624) was the forebear of John Locke’s theory of popular consent. He held that in transferring their original political power from a state of nature to a king, the people reserved important rights, including rights concerning taxation, vetoing laws and reclaiming political power (Rothbard, op cit, pp 117-119).
 
A recent book by Ángel Fernández Álvarez points out the striking similarities between Locke’s Two Treatises on Government (1689) and Mariana’s On the King and the Royal Institution (1599). Fernández points to evidence that Locke had read Mariana’s books and that he and Mariana had the same position on the origin of property in work as well as the similar views on natural rights mentioned above.

What about Spinoza?
Baruch Spinoza (1632-1677) was a Jewish-Dutch philosopher whose views were influential, but difficult for his contemporaries to cite. In the 17th century, being accused of being a Spinozist was apparently as hazardous for an author’s claim to have views worthy of consideration as being accused to be an atheist. Spinoza held that there is only a single substance, which may be called either God or Nature, raising the issue of whether he was a pantheist, an atheist, or a "God-intoxicated man".(Anthony Kenny, A New History of Western Philosophy, p 550, 552).

The similarity between many of the views of John Locke and Spinoza has been noted by Wim Klever (Locke’s Disguised Spinozism). Spinoza argued:
“Inward worship of God and piety in itself are within the sphere of everyone's private rights, and cannot be alienated.”
Spinoza held that such “opinions fall within a man's natural right, which he cannot abdicate even with his own consent” (George H Smith, The System of Liberty, 2013, p91).

Conclusion
Beliefs and values supporting natural rights of individuals to life, property and liberty seem to have travelled from Cicero to Locke through both the spontaneous evolution of rules and evolution of reasoning about the natural law. Those different transmission processes interacted. There were periods when reasoning about natural law held back recognition of individual rights to participate in mutually beneficial activities e.g. lending and borrowing. Eventually, however, reasoning about natural law reinforced and extended individual rights recognised under common law.

Do you acknowledge a personal responsiblity to seek mutual benefit?


In The Community of Advantage, which I reviewed in my last post, Robert Sugden observes that when individuals participate in market transactions it is possible for them to be motivated by mutual benefit, rather than personal benefit or even by the potential to use proceeds for altruistic purposes. They may see virtue in voluntary transactions that enable people to get what they want by benefiting others.

Sugden points out that being motivated by mutual benefit is consistent with Adam Smith’s famous observation that we do not rely on the benevolence of shopkeepers to provide us with the goods we need. The shop keepers don’t sacrifice their own interests to provide us with goods, but they may act with the intention of playing their part in mutually beneficial practices.

Sugden suggests that adoption of the principle of mutual benefit has implications for personal responsibility:

“According to that principle, each person should behave in such a way that other people’s opportunities to realize mutual benefit are sustained. But beyond that, no one is accountable to anyone else for his preferences, intentions, or decisions. Individuals relate to one another, not as one another’s benefactors, guardians, or moral judges, but as potential partners in the achievement of their common interests".

Individuals decide how to use the opportunities that are available to them, and accept sole responsibility for the consequences.

Sugden’s discussion of ethics includes responses to the virtue-ethical critique of the market of philosophers, such as Elizabeth Anderson and Michael Sandel, who argue for collective action by citizens to impose limits on the scope of markets - on the grounds that motivations of market participants are inherently non-virtuous and therefore liable to corrupt social interactions.

However, some virtue ethicists have adopted a much more market-friendly approach. I have in mind, particularly, the template of responsibility proposed by Douglas Den Uyl and Douglas Rasmussen in The Perfectionist Turn.

Den Uyl and Rasmussen suggest that “the fact that one must make a life for oneself is an existential condition”. To be a person is to have self-responsibility. Each person is primarily responsible for her or his own flourishing. Human flourishing involves “an actualization of potentialities that are specific to the kind of living thing a human being is and that are unique to each human being as an individual”.  Actualization “is dependent on the self-directed exercise of our rational capacities”. Flourishing amounts to the same thing as “the exercise of one’s own practical wisdom”.

As noted in an earlier article on this blog, an entrepreneurial analogy is used by Den Uyl and Rasmussen to describe what a flourishing life involves. Flourishing is activity rather than a passive state. It involves discovery of opportunities, and alertness to new opportunities amidst changing circumstances, rather than merely efficient use of the means at our disposal.

The authors suggest that if we accept that human flourishing is the goal of ethics, then we should learn from exemplars. People who have flourished in difficult circumstances may provide us with useful models of action. Of course, the idea that it can be helpful to personal development to identify and emulate the values that drive heroes has been around for a long time. It seems to work best for people who are sufficiently self-authoring to be able to recognise that famous people are not always good exemplars of human flourishing.

Den Uyl and Rasmussen argue that the ultimate value of the template of responsibility is integrity, which “signifies a coherent, integral whole of virtues and values, allowing for consistency between word and deed and for reliability in action”. They suggest that integrity expresses itself interpersonally in honour. Although acknowledging that honour may be “too old-fashioned a term for today’s usage”, they maintain that it does “capture the sense of what it means to greet the world with integrity”.

An alternative term, that captures some of that meaning, is trustworthiness. Den Uyl and Rasmussen briefly discuss the question of why they consider opportunistic participation in untrustworthy behaviour to be inconsistent with individual flourishing. They argue that such opportunism puts “the relationship we have with ourselves as a whole in disequilibrium by eroding what we ought to be in our relations with others generally”.

I have a vague idea of what that means. We can’t flourish if our behaviour is inconsistent with our values. Peoples’ consciences are often troubled when they engage in untrustworthy behaviour. When confronted with an opportunity to benefit unfairly at the expense of another person we sometimes hear people say, “I couldn’t live with myself if I behaved in that way”. I am not sure whether those sentiments are best explained in terms of evolved moral intuitions, internalisation of norms of reciprocity during the maturation process, a combination of both, or something else. Perhaps it doesn’t matter much how such sentiments are explained; the important point is to recognize that humans generally view untrustworthy behaviour to be inconsistent with their values.

Results of the trust game suggests that in a world we live in there seems to be a widespread expectation that even people we don’t know may be somewhat trustworthy. The trust game is a once-off game played between anonymous strangers (A and B). A is given $10. She can choose to keep it all or send some to B. B receives 3 times the amount sent by A. B can choose to keep all the money she has received, or send some back to A. In the results of games reported by Robert Sugden, A players sent on average $5.16 and received back $4.66, with B players keeping $10.82.

Sugden suggests that the willingness of A players to send any money to B players can explained in terms of their expectation that B players can be trusted to play their part in producing mutual benefits.  

In real world interactions, people have greater knowledge of the trustworthiness of others. Sugden points out that the principle of mutual benefit requires trustworthiness:  

"In an economy in which there is a general tendency for people to act on the Principle of Mutual Benefit, it is in each person’s interest that other people expect him to act on that principle”.

He explains:

In choosing whether or not to enter a trust relationship, each individual is free to judge for herself whether or not that will be to her benefit, taking account of the possibility that other participants may be untrustworthy. To the extent that some person, say Joe, can be expected to act on the Principle of Mutual Benefit, he can be seen by others, and sought out by them, as a potential partner in mutually beneficial interactions that those others are free to enter or not enter, as they choose. Thus, Joe’s being seen in this way allows him to access opportunities for benefit that would be closed off if his potential partners expected him always to act on self-interest."

That reasoning might suggest to some readers that it is more important to establish a reputation for trustworthiness than to have an intention to be trustworthy. A lot of commercial advertising seems to make that presumption. Fortunately, there is some evidence that individuals’ dispositions toward trustworthiness are translucent. When people have face-to face interactions with others they are quite successful in predicting who will cooperate and who will defect. On that basis, Sugden suggests that having a disposition to act on the principle of mutual benefit makes it more likely that other people will expect you to act in this way.

Summing up, accepting responsibility for making something of one’s own life is an integral part of what it means to be a human, and seeking mutual benefit in interactions with others follows naturally from that. Integrity in our behaviour toward others is of central importance to flourishing because we cannot flourish if we don’t live according to our values, and because we cannot flourish unless other people trust us sufficiently to seek mutually beneficial interactions with us.

Does the I-You relation enter into every aspect of the moral life?



Roger Scruton argues in On Human Nature that the “I-You relation enters essentially into every aspect of the moral life”.

That strikes me as an exaggeration. Examples readily come to mind of the exercise of the traditional virtues of prudence (practical wisdom) and temperance (moderation) that do not involve other people. We can make the ethical judgement it is good to exercise practical wisdom by managing our food intake and exercising regularly without considering possible benefits that might have for others. We can make the ethical judgement that it is good to be able to respond with moderation when our computers misbehave, even if there are no other humans nearby to witness unrestrained emotional outbursts.

So, why does Scruton take such an extreme position on the importance of the I-You relation? Scruton follows Stephen Darwall, who argues that the moral life depends on the “second-person standpoint” – the standpoint of someone whose reasons and conduct are essentially addressed to others. In attempting to explain that proposition, Scruton argues that it is “only because we enter into free relations with others that we can know ourselves in the first person”. He presents two supporting arguments – one from language and one from recognition.

The argument from language, associated with Wittgenstein, is that first-person awareness arises from mastery of a public language and recognition that others are using the word I as I do, to express what they think or feel directly.

The argument from recognition, associated with Hegel, is based on the claim that in a state of nature, motivated only by my desires and needs, I am conscious, but without the sense of self. The sense of self arises from encounters with other humans and the struggle for survival.

It seems to me that the argument from language fails because it does not explain why first-person awareness would depend on having words to express what that feels like.

The argument from recognition fails because it does not explain why it is necessary to identify other humans as having self-awareness before being aware of your own thoughts and feelings. Indeed, it is not clear how any individual human can ever be certain that other humans are self-aware – we assume that others are self-aware as we observe their behaviour because of introspection about the way our own actions are related to our thoughts and feelings.

Within a few decades, we could well be assuming that some robots are self-aware because they seem to behave as though they are self-aware. Incidentally, just now when I asked Siri if she is self-aware, her response was: “Not that I am aware of”. I expect she has been programmed to make that response, but it is the kind of response one might expect from a self-aware human trying to appear to be clever.

In attempting to provide a functional explanation of self-awareness, it is not clear why Roger Scruton gives so much credence to the speculations of Hegel. He persuaded me earlier in the book that much human behaviour, including laughter, can be better understood in terms of its social meaning rather than evolutionary causes. But evolutionary causes are pertinent to functional explanations. We should not lightly dismiss the possibility that self-awareness provided evolutionary advantages to the individuals who possessed it by helping them to survive terrifying solitary endeavours, as well as to compete with and to cooperate with other humans.

Of course, we don’t need to ask how we came to have self-awareness if we acknowledge that the fundamental problem of ethics is taking responsibility for how we live all aspects of our lives. It is sufficient to acknowledge that we have self-awareness, which entails the ability to reflect upon our own behaviour, feelings and thoughts.

The template of responsibility, advocated by Douglas Den Uyl and Douglas Rasmussen in The Perfectionist Turn, bases ethics on “the existential fact that we must make something of our lives”:

“For the template of responsibility, the basis for determining worthiness is human flourishing or wellbeing of some sort. Its ultimate value is integrity. Integrity expresses itself interpersonally in honour but when applied to the agent herself, the term ‘integrity’ signifies a coherent, integral whole of virtues and values, allowing for consistency between word and deed and for reliability in action” (p 20).

By contrast to the template of responsibility, the template of respect refers to the view that ethics as essentially about relations among persons. Den Uyl and Rasmussen note that Stephen Darwall’s second person perspective provide a prime example of the template of respect. Darwall’s perspective leads him to the view that ethics is essentially a social or communal phenomenon. He sees our sociable nature as giving rise to moral obligations conceived in juridical terms. Den Uyl and Rasmussen comment:

“Darwell wants to suggest that it is only reasoned and reasonable claims and demands that we can make upon one another. And yet, unless a determination of what is reasonable is left to individuals, there is … nothing beyond the grasp of what might potentially become the subject of publicly dictated forms of claiming and demanding” (p 167).

In the hands of Roger Scruton, the founding of ethics in the I-You relation leads eventually to approval of Hegel’s assertion that the dialectical opposition between the family, as a sphere of pious obligations, and the market, as a sphere of free choice and contract, “is transcended and preserved in a higher form of unchosen obligation – that towards the state”. Scruton asserts:

“The bond of allegiance that ties us to the state is again a bond of piety”.

In Roger Scruton’s framework, ethical conduct almost seems to be equated with accepting obligations and following rules, rather than accepting responsibility for one’s own actions. To his credit, he condemns the commandants of concentration camps “given to obeying orders and willing to sacrifice their conscience to their own security when the time to disobey had come”. But he doesn’t seem to understand that people who feel a bond of piety to the state are likely to be particularly challenged when it comes to knowing when the time has come to disobey.

Before concluding, I want to note that I enjoyed reading On Human Nature, despite the impression that might be given by what I have written above. I found Roger Scruton’s discussion of the limitations of the explanations offered by evolutionary biology to be particularly illuminating.

How can people become more open to critical evaluation of their own views?


It might not be obvious to everyone that it is desirable for people to be open to critical examination of their own views. The process of critical examination takes time and energy and can be unsettling. If it leads a person to change his or her view, relatives and friends might disapprove.


What is the problem with immunity to change? One problem is failure to actualize potential. In the first chapter of their book, Immunity to Change: How to overcome it and unlock the potential in yourself and your organisation, Robert Kegan and Lisa Laskow Lahey provide evidence suggesting that immunity to change of attitude tends to hinder mental development of adults. Survey data indicates that there is potential for mental development to continue throughout adulthood, at least until old age. Development tends to occur unevenly, with periods of change followed by periods of stability.

Researchers have identified three adult plateaus of development corresponding to different meaning systems that people use to make sense of the world and operate within it:

·         A socialized mind enables an individual to be a faithful follower and team player.

·         A self-authoring mind can generate an internal belief system/ ideology/ personal code and is self-directed. It places priority on receiving the information it has sought and creates a filter which determines what information it allows to come through.

·         A self-transforming mind can step back from and reflect on the limits of personal ideology and systems of self-organisation. Individuals at this level of mental development value the filter they have created to separate the wheat from the chaff, but they also value information that may alert them to limits of their filter.

Individuals at each successive level of mental development can perform the mental functions of the prior level as well as additional functions. A person who had attained the self-transforming stage of development can be self-authoring when required to develop and execute a plan of action, and can also be a team player when that is appropriate.

Studies involving several hundred participants suggest that most people (58% of respondents) have not attained a self-authoring level of development. Of the remainder, only a tiny percentage have self-transforming minds. The studies probably exaggerate the level of personal development of most of the population because they were skewed towards middle-class professionals.

This research seems highly relevant to questions considered recently on this blog about echo chambers in the social media and the reluctance of many people to listen to opposing viewpoints, as well as to consideration of the ingredients of good leadership. The vast majority of those who aspire to be able to reflect objectively on the limitations of their views of how the world works are likely to be biased against seeking information that might challenge those views.

As the title of the book suggests, Immunity to Change is about overcoming the psychological resistance that that prevent us from making the changes we want to make in our own lives and within organisations. The book is replete with examples, drawn from the extensive consulting experience of the authors, to illustrate how people can identify and deal with hidden fears that prevent them from making the changes they want to make. Most readers of this book are probably aspiring to leadership positions or attempting to change organisations, but much of the material in it is relevant to anyone who is attempting to make changes in their lives.

I will focus here on the approach to overcoming internal resistance that the book might suggest for a person who wants to become more open to critical evaluation of his or her own views on issues that have become highly politicized. I will provide my own responses to the series of questions suggested by the authors, rather than speculate about how others might respond. Hopefully my introspection will have some relevant to others.

1.       What is your improvement goal?

As already noted, I want to be more open to critical evaluation of my views on issues that have become politicised. My reason for doing this is that I suspect the opposing side on such issues might sometimes have genuine concerns that are worth considering.

2.       What are you doing/ not doing instead?

I rarely read opinion pieces by commentators whom I consider likely to be opposed to my views on controversial issues. I have sometimes expressed the view that I need to be paid to read such commentary.

When friends and relatives challenge my views on controversial issues, my response is often overly defensive. I begin such conversations with the intention of ensuring I understand the opposing point of view, but I am easily diverted to point scoring.

3.       What hidden competing commitments prevent achievement of your improvement goal?

When I imagine myself reading commentary that is opposed to my views I feel that I am likely to be bored by a recitation of views that I have previously rejected. It seems like a waste of time. However, I must also acknowledge fear that reading such commentary could be unsettling. The authors of these pieces often do their best to appeal to the emotions of their readers. I acknowledge some concern that I might need to modify my views if I start feeling sympathy for the plight of victims of policies that I support. The hidden commitments underlying those concerns are not feeling unsettled and not being swayed by appeals to emotion.

My defensiveness in conversations on controversial topics with people with opposing viewpoints seems to be related to the tendency for such conversations to degenerate into point-scoring exercises in which participants attempt to attach labels to each other. I am concerned that I might respond in kind if conversation partners disrespect me. The hidden commitments are to avoid being labelled and to avoid losing self-control.

4.       What are the big assumptions that underlie this immune system?

I accept that the hidden commitments identified above act as an immune system to prevent progress toward my improvement goal. I can see why I am unlikely to be able to make much progress merely by forcing myself to read commentary that is opposed to my views, or by telling myself not to become defensive when discussing controversial issues. The hidden commitments identified above have been acting as an anxiety reduction system.

 The authors of Immunity to Change explain the concept of “big assumption” as follows:

"We use the concept of big assumptions to signal that there are some ways we understand ourselves and the world (and the relationship between the world and ourselves) that we do not see as mental constructions. Rather, we see them as truths, incontrovertible facts, accurate representations of how we and the world are.
These constructions of reality are actually assumptions; they may well be true, but they also may not be. When we treat an assumption as if it is a truth, we have made it what we call a big assumption."

The big assumptions underlying the hidden commitments I have identified seem to be related to self-trust. There is an assumption that I can’t trust myself to feel sympathy for the plight of some unfortunate people without losing my mental faculties. There is also an assumption that I can’t trust myself not to lose control if I am disrespected.

Identifying those big assumptions was an “aha” moment for me. The absurdity of the assumptions seemed obvious as soon as they were identified.

However, Kegan and Lahey emphasize that the process of overcoming immunity to change does not end with identifying big assumptions. The next step is to design tests capable of disconfirming the big assumptions. The tests involve changes in usual conduct that generate information that we can reflect upon to challenge the big assumptions. The authors emphasize that the purpose of running the tests is not to see whether performance has improved, but to generate information to provide a learning experience.

This is where my story ends. In writing this article I have ‘tied myself to the mast’ with a public commitment to test my big assumptions. However, it could be counterproductive to disclose what tests I have in mind, and I’m certainly not going to promise to write a sequel to tell you what happens.

Even if it achieves nothing more, this exercise of identifying big assumptions has made me more appreciative that the difficulty other people have in being open to critical evaluation of their own views could well be attributable to deep-seated fears.

What are the ingredients of good leadership?


As I contemplate leadership failures in some major organisations, in Australia and elsewhere, it strikes me that the people responsible for those failures have not been meeting the norms of behaviour expected of responsible adults. For example, it doesn’t seem like responsible adult behaviour to persist in charging customers for services that they haven’t received.

That has me wondering whether the prevailing emphasis on inspiring organisational leadership rather than efficient administration could be responsible for a decline in the quality of senior executives. It seems to have become possible for some people to rise to the top by learning how to present a vision and flatter stakeholders, without acquiring management skills and business ethics along the way. Perhaps we are seeing a shallow leadership culture displacing the long-standing management culture that encouraged business leaders to take pride in being trustworthy.


Should the gurus who began promoting an emphasis on organisational leadership about 30 years ago be held responsible for the shallowness of leadership in some modern organisations today?  As that question arose in my mind I decided to revisit a book that I had read about 30 years ago - On Becoming a Leader by Warren Bennis, a famous leadership guru. I had a vague recollection that Bennis argued that organisations need leaders, not managers. 
My recollection was correct. The book contains a heading: “Leaders, Not Managers”. Under that heading there is a list of differences between leaders and managers. For example: “The manager administers; the leader innovates” and “The manager has his eye always on the bottom line; the leader has his eye on the horizon”. I don’t see recognition that organisations need leaders who have both high-level management and leadership capabilities.

However, the concept of leadership that Bennis advanced is far from shallow. He can’t be held responsible for readers who think leadership just involves mastering jargon about visions and stakeholders.

Bennis presents the view that “leaders are people who are able to express themselves fully”. He explains:

“The key to full self-expression is understanding one’s self and the world, and the key to understanding is learning – from one’s own life and experience”.

Bennis lists the ingredients of leadership as: a guiding vision; the passion to pursue that vision; integrity (encompassing self-knowledge, candour and maturity); trustworthiness; and curiosity and daring.

Those seem to be characteristics that would be displayed by any flourishing adult. As noted in an earlier post, human flourishing also requires alertness to the new opportunities emerging in changing circumstances.

That makes me to wonder whether there is any difference between the characteristics of a good leader and those displayed by any flourishing adult human. Toastmasters International, an organisation dedicated to assisting members to acquire leadership skills, as well as to improve communication skills, suggests one possible difference: “Great leaders inspire others to follow them”.

That difference is probably not important. Flourishing adults tend to display attributes required to attract followers, even when they don’t seek to be followed. They can’t avoid setting an example of behaviour that some others might choose to follow. As implied in the mission of Toastmasters clubs, the development of communication and leadership skills results in “greater self-confidence and personal growth”.

Perhaps I should try to sum up. It does seem possible that recent leadership problems in some major organisations are attributable to a shallow leadership culture. Some of these problems might have been avoided with a more conventional management culture - less emphasis on public relations and more emphasis on maintaining efficient and ethical management practices. Leadership gurus, such as Warren Bennis, might have contributed to such problems by downplaying the importance management skills. Nevertheless, the ingredients of leadership identified by Bennis are characteristics of flourishing adults - people who act with integrity. Organisations need leaders who have both high-level management and leadership capabilities.

 One question which I have not addressed is whether it is possible to identify intermediate stages in acquiring leadership capabilities. Do you have to learn to think for yourself before you can be a leader? Does Robert Kegan’s concept of self-authoring represent an intermediate stage in development of leadership capabilities?

How many rules for life can you remember?


A few hours after I had finished reading Jordan Peterson’s “12 Rules for Life: An antidote to chaos” I thought it might be interesting to see how many of his rules I could remember.
I remembered: stand up straight; use your past performance as a benchmark for comparison rather than other people; have meaningful objectives; don’t let your children do anything that makes you dislike them; be a good listener; be precise in your speech; tell the truth; and the one about setting your house in “perfect” order before you criticize the world. That is 8 out of 12. The rules are paraphrased as I remembered them rather than quoted directly.

I would not have much trouble explaining in terms of my own experiences why I remembered some of those rules. For example, the lessons that I had about 20 years ago in the Alexander technique left me with some knowledge of the links between posture, attitude and intention, as well as scepticism about the utility of the injunction to “stand up straight”. I remembered the rule about setting your house in perfect order before you criticize the world because I doubt whether anyone ever has their house in “perfect order”. I certainly have no intention of refraining from criticism of the views of “the radical left” until I get my house in “perfect” order.

The four rules that didn’t come readily to mind were: “treat yourself like someone you are responsible for helping”; “make friends with people who want the best for you”; “do not bother children when they are skateboarding”; and “pet a cat when you encounter one in the street”. The meaning of the last couple of rules is not self-evident. The one about skateboarding is mainly about encouraging boys to acquire manly virtues. The one about petting a cat seems to be about taking advantage of opportunities to notice that we live in a wonderful world, despite the suffering that is attendant upon existence. That is just my interpretation. As Nathan Robinson has noted, Jordan Peterson does not always abide by his own rule to “be precise in your speech”.

My purpose in revealing how many, or how few, of the 12 rules for life I remembered is to open discussion about the accessibility of the rules Dr Peterson has offered, rather than to confess the imperfections of my memory. A month, or so, after reading Peterson’s book a few cult followers will remember all his rules, but I doubt whether many other readers will remember more than 1 or 2 of them. That is because Jordan Peterson’s selection of rules seems arbitrary, and he has failed to organise them in a systematic way that might make them easily accessible.

The best way I can illustrate the arbitrary nature of Dr Peterson’s rules is by referring to the 12 rules for life that Russ Roberts developed for himself after interviewing Jordan Peterson. Although Roberts acknowledges that his list of 12 rules for life was inspired by Peterson - and there is a lot of overlap between the sentiments covered in both lists - they look quite different. There are also differences in emphasis. For example, the first rule on Roberts’ list, learn to enjoy saying “I don’t know”, might be implied by Peterson’s rules about telling the truth and listening, but in my view, he doesn’t give this rule as much prominence as it deserves. If other people can develop a different set of rules for life, it is reasonable to ask what would make Peterson’s list superior to one that might be drawn up during a brain storming session by any randomly selected group of people.  

Dr Peterson’s list of rules would be more memorable if they were related in an obvious way to a central organising principle. His book has underlying themes, but those themes are not evident in his list of rules. Perhaps someone could develop a mnemonic to help people remember the items on his list, but that would trivialize the whole exercise.

As I read through the 12 rules, the rule “pursue what is meaningful (not what is expedient)” strikes me as being of central importance. Dr Peterson’s offers several definitions of meaning, all poetic rather than precise.  The definition that seems to come closest to the central theme of his book is this one:

Meaning is the ultimate balance between, on the one hand, the chaos of transformation and possibility and on the other, the discipline of pristine order, whose purpose is to produce out of the attendant chaos a new order that will be even more immaculate, and capable of bringing forth a still more balanced and productive chaos and order. Meaning is the Way, the path of life more abundant, the place you live when you are guided by Love and speaking Truth and when nothing you want or could possibly want takes any precedence over precisely that” (p 201). 

That passage brings to mind an attempt I made a few years ago to understand the meaning of Dao. We can feel that we have some understanding of Dao, but it is difficult to be precise in our speech about it. My limited understanding left me feeling that it is wise to proceed with minimal rules, waiting to observe how things develop, and redirecting with minimal effort the things that are subject to our influence. I’m not sure that Jordan Peterson would agree.

If I push myself to be precise, what I would mean by pursuing what is meaningful, is pursuing what is important to you in the various domains of life.

In the personal domain we seek to understand what we know and what we don’t know, where we have been, where we are now, what we value, and what values we want to be expressed by the persons we are becoming. Our values determine our intentions, our attitudes and our posture. We want to improve, so we focus on our intentions in what we do, rather than our expectations of how we will perform based on how we have performed in the past. We measure our performance by comparison with our own past, rather than the performance of other people. We treat ourselves like persons we are responsible for coaching. We seek friends who want the best for us, providing encouragement and taking us to task as appropriate.

As regards interpersonal relations, we seek to place particular importance on authenticity and trustworthiness. We listen to what others have to say because they may know something that we don’t.  We seek to be precise and forthright in communication. We encourage our loved ones to behave in ways that will enable them to be widely liked and respected.

We approach the world with humility. We don’t seek to govern the lives of other people because we know the shortcomings in our governance of our own lives. We avoid the temptation to be over-protective of young people because they have to learn from experience how to take responsibility for their own lives.

So, that probably covers more than enough rules for life. If you can only remember one rule, the most important rule is to remember to do what is important.  That rule in particularly useful to remember when you find yourself falling into the trap of trying to avoid negative thoughts and feelings. Doing expedient things to make yourself feel better is likely to end up making your life more chaotic.

I would like to end this somewhat critical post by acknowledging that there is much that I like about Jordan Peterson’s “12 Rules for Life”. In fact, my main point is that it is unfortunate that the author has not found a way to make the messages of the book more memorable.

How do we know what we value?


“Although feelings are the one output of the adaptive unconscious that is likely to reach consciousness, sometimes even feelings are unconscious. And other contents of the adaptive unconscious, such as personality traits and goals, are likely to remain beneath the surface, unavailable to conscious scrutiny (the beam of the flashlight).”

The quoted passage is from Timothy Wilson’s book, Strangers to Ourselves: Discovering the adaptive unconscious. The author views the adaptive unconscious as a “necessary and extensive part of a highly efficient mind”. Its functions include “warning people of danger, setting goals, and initiating action in a sophisticated and efficient manner”.

The context of the quote is a discussion of introspection as a means by which people can “try to decipher their feelings, motives, traits, or values, not to mention what they want for dinner”. The “beam of the flashlight” refers to a metaphor in which the mind is thought of as a cave, with consciousness constituting those objects that are not currently in the beam of the flashlight. The quote seems to imply that our values and preferences are not necessarily easily accessible by just focussing our awareness inwards.

Tim Wilson argues that because people “cannot directly observe their nonconscious dispositions, they must try to infer them indirectly, by, for example, being good observers of their own behaviour”. He suggests that when we discover important truths about ourselves through introspection we do so by constructing stories about our lives, much as a biographer would. Trying to access unconscious goals and motives results in “a constructive process whereby the conscious self infers the nature of these states”.

I felt somewhat bemused when reading that - presumably because of my training as an economist. The idea of being able to discern our values and preferences from our behaviour seems to have more in common with the neoclassical economists’ notion of ‘revealed preference’ than with the view of many psychologists (and behavioural economists) that people are prone to make irrational choices because of cognitive biases that reflect non-conscious influences.

Of course, Tim Wilson does not suggest that the adaptive unconscious always makes the right choices for us. He notes that it is important to distinguish between “informed and uniformed gut feelings” by gathering as much information as possible to allow your “adaptive unconscious to make a stable, informed evaluation rather than an ill-informed one”.  His main point seems to be that in order to make good decisions, e.g. in choosing a spouse or buying a home, you need to avoid over-analysis by the conscious mind.

Does it make sense to try to try to infer your values from your past behaviour? If the aim of the exercise is self-improvement that approach might appear to be futile. If you see need for improvement in your behaviour, it isn’t immediately obvious how the values that can be inferred from your past behaviour could provide helpful guidance.

So, how can people bring their values to awareness in order to engage in self-improvement exercises? Tim Wilson has some suggestions, but before considering them it might be useful to consider approaches adopted by some psychologists engaged in therapy and personal training.

Acceptance and Commitment Therapy (ACT) places a heavy emphasis on living according to values, so the approach adopted by ACT therapists might be of particular interest. One approach used in ACT is the life compass, which ask people questions to elicit values in various domains of their lives – relationships, health, work, leisure etc. People are asked what is important or meaningful to them, what sorts of strengths or qualities they want to develop and what they want to stand for. That approach obviously works if you can find what you value by just shining the flashlight into your cave. But to do that you must have a fair amount of self-knowledge already, and you would probably have constructed a story about where your values have come from.

ACT offers a range of techniques to elicit values if they don’t readily come to consciousness. One technique noted by Russ Harris in ACT Made Simple is to imagine what you would love to hear people say about you, and what you stand for, in short speeches at your 80th birthday party. (Dr Harris presumably doesn’t have many readers who are over 80.) In The Reality Slap, he suggests that it is also possible to elicit values by remembering a “sweet spot”, a memory that encapsulates some of life’s sweetness for you. After appreciating that memory, he asks people to notice the personal qualities they were exhibiting and what this reveals about the personal qualities they would like to embody.

The Authentic Happiness web site (stemming from Martin Seligman’s book of that name) has, among other things, an extensive questionnaire that enables people to discover their ‘signature strengths’. People taking the questionnaire are asked to what extent 240 statements describe themselves. The statements seem to be largely about dispositions rather than past behaviours, so seem to assume prior knowledge of dispositions.

The Enneagram Institute offers people an opportunity to discover more about their personality type through a questionnaire (the RHETI) which asks participants to choose between 144 paired statements relating to their past behaviour. One of the potential benefits of this approach is that it seems to offer a way for people to identify values that can guide them toward attainment of higher levels of personal development, without having to attempt to make fundamental personality changes.  For example, a person who has a persistent desire for self-control could see himself, or herself, as having many of the characteristics of a Reformer, and thereby see potential for growth by becoming more reasonable, and progressively acquiring greater wisdom. Some more examples might help to make the point: a person who seeks to avoid conflict through accommodation might have many characteristics of the Peacemaker, and see potential for growth by acknowledging her or his peacefulness and seeking to become indomitable; a person who is highly defensive much of the time might have many characteristics of a Loyalist, and see potential for growth by becoming more trusting, cooperative, reliable and courageous; and a person who is restless and constantly seeking stimulation might have many of the characteristics of an Enthusiast, and see potential for growth by becoming more productive and more grateful. Similar personal growth paths exist for the five other personality types.

A couple of the approaches described above bring values into conscious awareness through an explicit consideration of past behaviour. The sweet spot approach builds on selection of a particular memory, whereas the RHETI may help people to identify their potential by providing them with a systematic way to understand their past behaviour and personality. Unfortunately, although the RHETI is being widely used in personal training exercises, its predictions do not yet appear to have been subjected to a great deal of rigorous scientific testing.

One approach that Tim Wilson advocates is Pennebaker’s exercise which involves writing about the deepest thoughts and feelings associated with an important emotional issue. Although writing about emotional experiences is distressing in the short run, it apparently has positive long-run effects. The exercise seems to help people make sense of a negative event by constructing a meaningful narrative that explains it. A possible downside of this approach is that some people may dwell on negative life experiences by constantly revising their narratives. I expect that some people might also have a tendency to fuse with stories that make their lives miserable.

Tim Wilson acknowledges that some narratives are better than others. He writes:

"As with any biography, there are multiple ways of telling the story. A good biography, though, has to account for the facts of the person’s life and capture his or her inner goals and traits. The better a story does at accounting for the “data” of the person’s adaptive unconscious, the better off the person is. By recognizing their nonconscious goals, people are in a better position to act in ways to fulfill them, or to try to change them."

How can we change our non-conscious states in order to match our more positive self-stories? Tim Wilson suggests we follow Aristotle’s advice to acquire virtues by first putting them into action. We can change our feelings and traits by changing our behaviour. In order to “change some aspect of our adaptive unconscious, a good place to start is deliberately to begin acting like the person we want to be”.

The Revolution Inside

Peace and justice are two goals which the politically inclined often seek, but they are simultaneously inner qualities which a philosophical person must posses, not just external conditions which we would like to see in the world. If we want to see the world change we must first concern ourselves with healing our own lives.

In Xenophon's
Memoirs of Socrates, Hippias tells Socrates that instead of always asking questions about justice, he would do better simply to say, once and for all, what justice is. Socrates replies: "If I don't reveal my views on justice in words, I do so by my conduct." A modern parallel to Socrates' statement can be found in Martin Luther King's quote, "Peace is not merely a distant goal that we seek, but a means by which we arrive at that goal.”

What Socrates wanted to show is that we can never understand justice if we do not
live it. King similarly noted that we won't achieve peace through our actions if outwardly we are irrationally angry and inwardly we are a mess of anxiety and neurosis. We can't expect the world to give us better than we give the world.

In antiquity, philosophy was a way of life akin to therapy or care of the soul. Socrates,
the Cynics, Aristotle, the Epicureans and the Stoics all stressed that we can achieve autarkia, or inner freedom independent of external events.[1] Autarkia is a self-sufficiency and peace of mind where we feel that we lack nothing, relying on our inner resources. To be liberated, we must turn our attention to the revolution within and to what we can control; our thoughts, emotions, and actions. In order to obtain autarkia or inner freedom, we must train ourselves for it. 
Ancient Philosophy As a Way of Life
Pierre Hadot was a historian of philosophy who is also just as rigorous a philosopher. He was aware of limits of specialization in academia and sought cross-specialization within Classics. In his excellent book Philosophy as a Way of Life, Hadot maintains that philosophy did not change in essence during the entire course of antiquity. However, it evolved away from a therapeutic, lived experience to a theoretical discourse during the Medieval and Modern eras.

Hadot is explicit that in antiquity philosophy was understood as a way of life. Ancient philosophy is therapy for the soul - the goal is very different from that of much modern philosophy, which is primarily an academic exercise in exegesis, although
not exclusively so according to Dr. Greg Sadler.

For the Epicurean, Hadot notes that one form of philosophical therapy consists of bringing one's soul back to joy from the worry of living. Unhappiness comes as a result or worrying about things which are not to be feared or are beyond our control. By contrast, inner freedom or
autarkia is deliverance from worry about things we cannot control. Worry about external conditions often takes precedence in our lives, often to the point that we neglect what is going on inside. [2]
Politics as Externals Beyond Our Control
One external that philosophical people often fixate on - and for good reason considering the many problems in the world - is politics. However fixation on politics can be a dangerous thing if we neglect to care for our own souls and to remind ourselves that for the most part, political issues fit squarely within the realm of things which we do not control.

This dilemma isn't new. In Plato's
Symposium, Alcibiades remarks that Socrates has made him admit, "While I am spending my time on politics, I am neglecting all the things that are crying for attention in myself."[3] He goes on, "Socrates makes me admit to myself that even though I myself am deficient in so many regards, I continue to take no care for myself but occupy myself with the business of the Athenians."[4]

Socrates expected Alchibiades - and each person - to be excellent and rational and to care for their internal disposition. In this same vein, Hadot quotes George Friedmann’s 
La Puissance de la Sagesse (The Power of Wisdom) on the necessity of such a philosophical disposition for a politically oriented person:
Try to get rid of your passions, vanities, and the itch for talk about your own name, which sometimes burns you like a chronic disease. Avoid backbiting. Get rid of pity and hatred. Love all free human beings. Become eternal by transcending yourself.
This work on yourself is necessary; this ambition justified. Lots of people let themselves be wholly absorbed by militant politics and the preparation for social revolution. Rare, much more rare, are they who, in order to prepare for the revolution, are willing to make themselves worthy of it.[5]

What is being articulated here is a revolution inside, which is more important than political revolution. It is very difficult to live everyday life in a philosophical manner. We often fixate on the external conditions of life while neglecting what is going on inside of us. Philosophical exercises can us help in this regard.
Philosophical Exercises for Care of the Soul
Wisdom can be acquired through work on ourselves via ongoing philosophical or spiritual exercise. One philosophical exercise which we can practice everyday is essentially present moment awareness or attention to what we are doing, giving each thing its due. It's what Marcus Aurelius was talking about when he said:
Everywhere and at all times, it is up to you to rejoice piously at what is occurring at the present moment, to conduct yourself with justice towards the people who are present here and now, and to apply rules of discernment to your present representations, so that nothing slips in that is not objective. [6]

In
Philosophy as a Way of Life, Hadot comments on therapeutic value of writing. Hadot notes that writing or keeping a journal helps you explain yourself to yourself. Writing takes the place of another person's eyes. The writer instinctively feels as though he is being watched. This process helps makes what was confused or subjective more objective and universal for the writer. One observes one self to see what progress they have made using writing as an exercise.

The final philosophical exercise to care for our souls is inner transformation. This is what Socrates and Martin Luther King implored us to do; change our way of seeing and living so that we are self-sufficient inwardly and so outwardly we become our political ideal. To understand our object, we must become our object. To understand justice, we must be just in our dealings with others. To get peace, we must have peace in our own lives:
The trick is to maintain oneself on the level of reason, not to allow oneself to be blinded by passions, anger, resentment or prejudices. To be sure, there is an equilibrium - almost impossible to achieve - between the inner peace brought about by wisdom, and the passions to which the sight of injustices, sufferings, and misery of mankind cannot help but give rise. Wisdom, however, consists in precisely such an equilibrium, and inner peace is indispensable for efficacious action. [7]
